A BILL to amend article sixteen, chapter five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section five-b, relating to premium increase requests of the PEIA.

Be it enacted by the Legislature of West Virginia:

That article sixteen, chapter five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section five-b, to read as follows:
ARTICLE 16. WEST VIRGINIA PUBLIC EMPLOYEES INSURANCE ACT.

§ 5-16-5b. Director and board to review all PEIA premium increase requests.

The director and the board of the public employees insurance agency shall, when a determination is made to increase premiums, determine that all premium increases are fair and equitably proportioned to all subscribers of the public employees insurance agency system. If the director and board determines that any proposed premium increase is not fair and equitable, the proposed premium increase shall be rejected.




NOTE: The purpose of this bill is to require the director and board to review all requests for premium increases by the PEIA for a determination of fairness before approval.
